Stoop to Damian's level? Dick the original Robin. The guy who created and owns the mantle gave it to Damian. To give him purpose and give him direction [You know what the mantle was created for in the first place]
and later Batman the Guy who works with Robin gave endorsed Damian as Robin.
Robin does not belong to Tim and Dick had every right to take it and give it to the kid who needed it.

Dick had every right to take Robin from Tim as the creator of the mantle and Batman he had every right.
Tim has no right to just take back Robin.
