I like this posture and his prison suit. Reminds me a lot of Penguin's underwear in Batman Returns.

He deliberately attacked Batman in the most over the top way possible in order to get into Arkham and talk to Bane

He usually goes to Blackgate. Maybe using attacker penguins makes it easier for his lawyer to get insanity plea.

He is the biggest mystery so far. If this is the real deal, my current theory is he managed to rewire Skeets to bring him by time travel (if that how it works, I know nothing about Booster Gold) ...assuming that Flashpoint is considered part of the timeline despite it being an alternate reality... but I have no theory on his motivation yet... unless he's been brainwashed by Psycho Pirate and Hugo Strange. That's the simplest explanation.
If it's just an impostor then... it's not as interesting.
Well, at least King is icking up on the one things remotely interesting happening in Batman 50. And the art is great.

I'm really excited for this. I thought we wouldn't get a follow up on Batman #50 for a year (because I was so pessimistic at that time). And here we are, 8 issues later (4 months), and it's coming together!
Also...did Penguin have a relationship with a woman named Penny before?
Tempted to pick this up as its a direct continuation of 50.
Hopefully we get the ball rolling again on the main storyline of King's run. Sad no Daniels this issue, but Janin is no slouch.
Wonder when King will explain when/how Bane seemingly became the Kingpin of Gotham
I *love* Janin's art. A pretty sure fire way to get me to buy something is to put one of my favorite artists on it, so there go my money.

The only "Penny" I can think of associated with Penguin was in a Batman '66 comic where she was his moll (and got to kiss Robin to boot).
