    The switch in time that saved nine did /exactly/ that in the face of similar intransigence. People hear about the 'court packing scheme' and see it as an attack on the separation of powers. I'm not going to defend it on those grounds, because it certainly was a threat, but this was the Lochnar era court, which consistantly struck down pretty much every new deal program. It was already playing a judicially activist conservative role in that regard.

    We're agreed to an extent here, but you're ignoring an important point about who's voters reward what behavior.



    If you don't think that the Republicans won't do exactly that if the situations are reversed, you haven't been paying attention. Just like we all predicted they'd nuke the filibuster, which they are already in the process of starting.



    The GOP would love this given their advantages in the Senate.
    What are the chances the GOP or any party gets a 2/3rds majority in either House (let alone both) to actively veto a Presidential appointment? It's not going to happen. You'd need a bipartisan coalition to veto nearly any appointment.

    In the here and now? Some folks are voting with that end in mind.

    I'm not really seeing either side wanting a legitimately independent Judicial Branch.
