Matt generally beats them so bad they have second thoughts about going back to what they were doing, Batman just beats dudes and tosses them in Arkham (the place he knows they'll just break out of).

Also, IIRC Matt's actually crossed his own line, either by directly killing, or someone dying as the result of his actions; and has dealt with it. Batman hasn't, or at the least everyone acts like he hasn't.

Figure it's all about how the character is handled in the end though.

Yea, but he doesn't gas a city block for shits and giggles. Comparatively Fisk is hardly as detrimental to 'people staying alive' as the Joker is.

Frankly, if there's anyone of Bat's rogue gallery that should be eliminated at all costs and is a far greater threat, it's Ra's. Joker may kill people by the hundreds on occasion, but Ra's is constantly working his agenda towards darwinism and global genocide.

Honestly Ra's is one of the few villains with an easy out even if you do kill him. You gotta burn the body and scatter the ashes or they'll just dump him in a pit again.
