Before Spider-Man Classics, the precursor to Marvel Legends, started in 2001, all Toy Biz Marvel figures were in the 5" scale rather than 6", and their articulation was much more limited. That figure hasn't aged well at all, and even if you paid $40 for it (DON'T), it would look like a sad little pipsqueak compared to modern Marvel Legends figures.
My best advice is to get the Netflix-style Luke Cage/Claire Temple two-pack, and then sell Claire on eBay or something if you don't want her. Most '90s Toy Biz figures just look BAD by today's standards of sculpting and articulation. Whoever is asking $40 won't get it -- there is no demand for most '90s toys the way there still is for '80s toys (G1 Transformers, vintage Star Wars, Super Powers, Secret Wars, etc.)
