I just remembered Storm showed up in marvelsuper hero squad and considered part of the main cast of the black panther cartoon series and fox already owned xmen. so I think marvel can use any xmen on tv but not on films

Cartoons and games are different from live-action. Don't forget, Marvel had to wait for the rights to revert before they could start the Daredevil tv show.
