    He's pretty hard to sue - generally, he has no fixed abode. Although it varies from country to country, most allow for cases to be brought in the country the defendant (Superman) resides in. He's called Metropolis his home, so that bit is covered, however, serving him with documents may be tricky (superspeed etc).

    The sudden peril doctrine would probably be something used as a defence, and there are others that could be used, too.
    Some poor bastard would have to camp outside the fortress of solitude waiting for Superman to show up.

    As Superman has god-like powers perhaps any damage he did would fall under the "act of god" clause. Can you sue God if a tornado destroys your house?
