I guess so, but they may have limitations on using his name on the cover and stuff like that.
Then there's Dr. Doome who tangled with The Seven Soldiers of Victory. He disappered into time, so it would be logical for him to pop up in the present.
Definitely - at least until Captain Marvel can start using his name again.
Plastic Man did battle Dr. Dome in the 1960s.

We all know that DC had Captain Marvel first, but I was surprised to learn that DC had a "Spider Man" before Marvel's "Spider-man".
DC and Marvel also share Sandman--in DC's case, multiple versions of Sandman. I recall that they have an understanding where Marvel can't use Sandman as a hero and DC can't use him as a villain. But I don't know how true that is, since some of the Sandmen from DC have walked on the dark side.
