    The right does not fracture, they make a show of it sometimes but come election time they always vote in lockstep with the GOP. If only the left could do this, instead of constantly trying to nominate these milquetoast moderates that campaign on vague generalities and then do nothing when they get in office, we could get some firebrands in office and enact some real change for once.

    Senators confirmed 13 of President Donald Trump’s judicial nominees, bringing to 102 the number of federal judges approved this year — more than twice the annual average over the past three decades.

    The steady transformation of the courts reflects the single-minded focus of Senate Majority Leader Mitch McConnell, who has vowed to “leave no vacancy behind” as he and Trump seek to tilt the judicial branch to the right.
    Many of these, if not all, are lifetime appointments in the lower courts. They have been targeting the 9th District Court of Appeals in California, "the San Francisco-based court, which covers a wide swath of Western states from Alaska to Arizona, handles cases of high interest to the Trump administration, such as immigration and detention."

    Last week we saw the evil old fossil cackling with the odious Sean Hannity while bragging how he blocked all of Obama's court choices. Why do these hypocrites think only their choices should be placed on the courts?

    I believe this is worthy of more investigation.

    There are two possibilities. It could be that the military screwed up, failing to recognize white nationalism or covering it up.

    It could also be that major figures in the media messed up wildly, which requires self-reflection on how they could have mistakenly accused innocent people of something disgusting and how to make sure this never happens again.

    Dan Rodricks of the Baltimore Sun seems to think the dark suspicions were wrong. He suggests this is the fault of the Trump administration, writing "Our dark suspicions about this were wrong. Good. But ask yourself: Why did we think the worst? One of the reasons is still living in the White House."

    That rationale is deeply flawed, since many people will believe things that are wrong about all sides. It is always the fault of the person who is wrong.

    Republicans have the Senate and the White House, so this is how McConnell's able to make these changes.

    Conservatives do tend to care more about the courts. Another factor is whether the conservative arguments of judicial interpretation (originalism and textualism) are more defensible than the liberal arguments of judicial interpretation (pragmatism, stare decisis.)

    Originalism and textualism is fucking stupid. The founding fathers didn't expect their document to last 100 years. 200+ years later and people are poring over every minute detail to try and justify their own biases.

    To whit, Originalism and Textualism is like bleeding a patient with an illness whilst ignoring the obvious medication nearby.

    Judicial interpretation doesn't just refer to the constitution, but to the laws as well. One can look at the text of a federal law as well as the context in which it was created.

    Obviously, we shouldn't rely exclusively on old laws, which is why Congress has the power to make new laws.

    It's also why we have an amendment process for the Constitution. We shouldn't talk about the Founding Fathers like they're some kind of deities. They were men, and as such, full of human flaws.

    Not only that, but how many ‘originalists’ hold to statements by Jefferson that we should revise the Constitution REGULARLY to reflect the changing times? Absolutely none of them, because ‘originalists’ aren’t interested in progress, they crave the comfort of stagnation.

    Matt Shea and Michelle Fiore really ought to be in serious trouble given that report. They /should/ be up on charges.
