She was a clone of Jean so the decision made sense. The pre-HOX era was about getting rid of dupes bc they dont fit the concept of Krakoa and the Resurrection Protocols that were teased/established in HOX. For people that keep bringing up the Cuckoos, they were always a special case
Tbh, the behavior of the Council is not surprising. They've been shown to be assholes since HoX #6. I hope this time around that the characters in the story take notice and bring down this shoddy government / court

Madelyne wasnt just a clone of Jean Grey. She was originally brought to life with a portion of Jean's soul. In a roundabout way she was Jean. Upon her death, the portion of Jean's soul that gave her life was given back to Jean by the PF along with her memories as the two merged into one person. The human Maddie that existed in the 80s is a part of Jean. The two stopped existing as seperate characters with Inferno and have since been one being
The Maddie that was in Hellions was not the original Maddie. She was the psychic ghost that X-man created when he was reaching out for Jean and she was eventually given a magically tweaked body by Spiral to look like Jean. She's a demonic magical twisted perversion of Jean so I totally understand why the Council decision was made
Technically the Cuckoos are not Emma's clones, they are her daughters (they used eggs and they are not the same as her when she was her age).
What is certain is that they are clones of each other, but that is an intrinsic part of their modern-minded mutation. So ... it's complicated.
I understand both positions here. The Council does not want to open the door to clones, much less Maddie, who has been about to summon demons to destroy them. On the other hand, it is obvious that Maddie has evolved to be a different person from Jean. It's tragic.
What is also very tragic is that if Sinister voted against Maddie's resurrection, he will never have stopped destroying her life, and she will never have permanently escaped his control
