    This is a messed up situation, but a potentially positive outcome could be for Trump, Biden, McConnell and Schumer to announce a deal, that there will be no vote for a Supreme Court nominee until after the inauguration of a new President, in exchange for Democrats to agree not to allow court packing.

    That will never happen. Trump will pack the court. He sees this as his legacy. And as a huge screw you to Biden if he loses. And his pick could held him tie up the election results and help him steal the election. No way he sits on this,

    To what end? There’s no guarantee the Republicans don’t win the election? You want to swing the polls? Convince all the Never Trump Republicans that Democrats are going to stack the courts if they win and break all the norms. You’ll lockdown the evangelicals and virtually anyone who was toying with the idea of defecting from him. Hell the Lincoln Project might be running ads against Biden if that happens.

    And then Republicans can just say “okay, pack the courts, the next time we get power, we’ll confirm a new Justice every week so your next President will spend his whole term trying to undo the imbalance.

    Anyways it’s non factor and an empty threat. Biden said he wouldn’t. Sanders also said he wouldn’t. Nobody really wants that. It’s not a Democrat weapon. It’s a weapon that’s on the table for whoever has power and everyone knows you can’t guarantee the wielder.

    McConnell simply doesn’t give a ****. He already is on record saying he would do this, the White House is already telling people they will have a name soon. Your hope is that 4 Republicans can have morals for 4 months.

    The horrific reality is that they're going to push a conservative. The thing is though is that this is less to promote any specific policy but more to defend Trump if and of course when things go south given he loses office in November or he gains a second term to defend him from everything he fucked up in the first four years. Because putting it simple is that this rush to put in a SC nominee is less about pushing an agenda than Trump bring his case to the supreme court once law enforcement can actually act on Trump because rest assured they will. 2020 was the perfect storm for the GOP. Forecasts suggest Trump is just fucked and he doesn't have any sort of "Pizza-gate" to fall back on.

    Trump's fucked and he knows it.

    As much as Antonin Scalia pissed off liberals and progressives, at least the guy was willing to read and research the rule of law, even if he took the rule of law too literal. All the while holding a fork.

    They just want someone who'll go "whatever helps our side out the most, we support that outcome".

    Yup they will scrape the bottom of the barrel for a young loyal soldier. They can't have more traitors.

    And what people need to realize now is this isn't about the laws and rights we currently have.

    You want Climate change laws? Medicare for All ever? If Obamacare isn't struck down this year after Mitch sneaks in a ringer...it will be in jeopardy again and any potential Biden attempts to go in with fixes.

    All of them will surely be lawsuits if passed. And they will all end up in SC many times. That's why this was Mitch's endgame.

    At the end of the day Dems will have to be looking to get Puerto Rico and D.C statehood for potentially more Senators. Along with looking at more SC seats.

    That's certainly the most optimistic way to look at it. Trump is fucked regardless of what happens. But at the end of the day, I don't think McConnell cares. Pretty sure he'll have all that he needed out of Trump and he'll be cast aside.

    Scalia was awful by every metric. He just looks great next to Kavanaugh, that's how bad Kavanaugh is.

    That's what I meant by him taking the rules of law by the letter and not by context sensitivity. Conservatives like to do that to justify things; I mean, the Religious Right do it all the time with the Bible.

    However, at least he would make you feel like he would look into things, as opposed to the people McConnell and Trump want hired, who would have already made up their minds even before the case had started.
