    There has been plenty also written how they do not dismiss the "Well Regulated" part.. Heller was still a ruling that ignored President, for Scalia's own agenda.
    And many States specified White Men. So let's keep that too, huh?

    As for what is in green?

    That same Constitution pretty clearly lays out that the "Standing Army..."/"Militia..." part is pretty well divorced from individual defense.

    Is there an argument for that things have changed, and this should have changed along with it?

    Sure, a perfectly good one.

    Completely different thing than folks who seem to have missed out on pretty "Basics 101..." US history.

    As for that last bit?

    On this date in 2015, 2016, 2017, 2018, 2019, as well as 2020, “Crazy/Stupid Republican of the Day posted profiles of the current U.S. House Representative for Indiana’s’ 8th Congressional District, Larry Bucshon, who since getting elected to Congress in 2010, has participated in the widespread campaign of Republican obstructionism, and making a name for himself as an exemplary climate change denialist. See, in September of 2014, he actually made the claim that climate change science is fraudulent because scientists are only producing studies that say it exists, and it is man-made, because if they didn’t, they would be out of a career. Never mind that scientists produce DATA to back up what they’re saying all the time, though. Bucshon is opposed to same-sex marriage to the extent that he has went on record to whine about how he felt the Justice Department wasn’t enforcing the Defense of Marriage Act and is so Pro-Life that he sponsored the “Life Begins at Conception Act”, which would have effectively not only criminalized abortion, but most forms of birth control. Bucshon also voted for the 2013 Government Shutdown, and at the vote to re-open the government, voted to keep it closed. He did the same in late 2018 to early 2019 with the longest government shutdown in our nation's history, as well.

    Bucshon, though, still gets to enjoy a +15 Republican lean that Indiana’s 8th Congressional District has, and that helped him get re-elected with 67% of the vote in 2020. He has returned to the capitol, and now in the minority party, remains a hyper-partisan twit.



    Bucshon’s actually got an MD, but we’re going to be honest, the man seems to have forgotten the Hippocratic Oath. Instead, he has apparently recited the loyalty pledge to Donald Trump, because he ignored all medical experts and all logic that he should have picked up in med school this past year, proving so when he called for the country to “reopen” in April of 2020. Regardless of if that opening would cost, y’know, tens of thousands of lives. In June 2020, he was throwing a tantrum that Nancy Pelosi has mandated members of the House and staff continue to wear masks unless providing proof they have been vaccinated, pointing out that many people like him will refuse the vaccine until their last.

    Again, a former doctor, not just refusing life-saving vaccines, put putting his own politics ahead of public health with an ignorant f***ing statement like that.

    Larry Bucshon has now been in office 12 years, and somehow the people of Indiana’s 8th have yet to realize his dumb ass has accomplished nothing in that time for their benefit. No major legislation passed, nothing of note except some dumbass empty quotes. (HINT: They can do better.)

    I quote Ken White (AKA Popehat) a lot, and I suppose one reason I find him reliable is that he's open about the times his understanding of the law differs from what he would do if he were in charge.

    Eichenwald's interpretation is interesting in that he thinks Heller was correct when it came to handguns and DC law, but Scalia was wrong to go with a broader ruling.

    This gets messy, as handguns are a majority of gun homicides.

    Heller is still a major decision by the Supreme Court, so lower courts are bound by it, even when considering the applications to a law passed before that decision.

    If Heller says that that a law is unconstitutional if it "bans a firearm that is commonly owned by law-abiding citizens for lawful purposes" that is the current legal understanding.

    It's also entirely reasonable for a judge to agree with a relatively recent Supreme Court majority.

    Later amendments and decisions expanded the right beyond white men.

    If the fourteenth amendment is important, it's also going to be relevant to the second.

    Not a fan of Trump, but probably should hold up on making fun of forgetful people who may not have control of all their bodily functions while also supporting Joe Biden. I support him too, but watching him speak sometimes feels like watching an 8 year old kid trying to properly recite their lines in in a school play in that I cringe at times and think to myself "oh please don't f##k this up" or "c'mon Joe, you can do it". Less so now that he has the Presidency, but it was pretty bad for a while.

    And, if true, also pretty far down the list as far as objectionable traits he has. Almost makes you feel sympathetic, humanizes him. Almost.

    Part of Biden's speech patterns is that he is a stutterer. He will pause and find another word when he feels he might start to stutter.

    He is basically waiting for the Party that is passing voter suppression bills, and has publicly stated that that is the only way they can win, to join the Democrats on laws to fight Voter Suppression.
    It's hard to know if he is just blind to what the Senate and the GOP has become because these are his "buddies". Or he knows what he is saying is bullshit and he just doesn't give a damn if we lose our Democracy.
