The first X-Man to have access to it after Xavier was Scott - it having a safe setting for non-telepaths has been long established. Alternatively, Mystique could have done what Reed Richards did in Earth X - shape-shift her brain to be more conducive towards telepathy.

Well, am talking from a resurrection protocol pov. This just establishes that anyone can restore memories, as long as the-5 resurrects the bodies.
