I've read that Byrne originally wanted to base Krypton in his reboot on the Donner version but couldn't due to legal issues...could it be for the same reason?
Anyway, whatever it is, it didn't stick, given that we basically had the Donner Krypton in comics canon after IC, and I think the current take on Krypton in the comics and in other media as well is heavily inspired by this version.
The look of Krypton in Donner's film came about because of the work of production designer John Barry. I think Puzo's vision of Krypton's asthetic was non specific and such things were left somewhat vague in the script to allow the original director Guy Hamilton and his people leeway on how it was to be interpreted on screen. Thus, DC and Warners are free to use the visual elements of Krypton without violating Puzo's stipulation.
When it comes to comics,one person's "fan-service" is another persons personal cannon. So by definition it's ALL fan service. Aren't we ALL fans?

I guess the stipulation only covered adapting specific scenes from the movie then? Because a lot of elements from the movie have ended up replicated in the comics and other media - the Fortress grown from a kryptonian crystal, the Jor-El hologram etc. Probably a few more things I'm missing.
