I think contracts are very explicit but sometimes use things like "and related characters." I think that was the gray area that Scarlet Witch and Quicksilver were in. The contract might have said "Magneto and related characters" (not meaning LITERALLY related but 'associated') but did not name them. In the FF contract it might have said "Galactus and related characters." Neither company really wants to spend lawyer money when they don't have to.
