    But that's if they have a 100% control of the property, which isn't the case here, I believe.

    that depends on how you define "property". DC does NOT own the story. DC only owns the art. does this make one public the other not? hmm... interesting legal question.

    The art would definitely not be public domain, at the very least. It's like some episodes of Bonanza and The Beverly Hillbillies that are now in the public domain, but not their famous theme songs. The latter have been substituted with completely different instrumentals.
