    That world is deeply, deeply flawed though. If Marvel did regain the creative rights to cinematic Spider-Man, then I have little doubt that audiences will return for one more Spidey reboot. Why? Because this Spider-Man is being made by Marvel Studios, whom they have learned they can count on for thrilling, entertaining, and engrossing comic book cinema (excluding Iron Man 3, of course).

    Same as with any franchise-movie, really: Give it to a director with a clear vision, and keep the number of writers and edicts from the studio down to a minimum. Those three bullet points have, in varying degrees, been the main problems of all the Spider-Man films post SM 2.

    That's really the heart of the problem.

    The other thing is Marvel. They want the rights to use Spider-Man in their cinematic universe. And considering they turned Guardians of the Galaxy into the biggest film of 2014, what must they think they could do with Spider-Man?

    I could see them trying to set up a New Avengers thing, with Age of Ultron acting as Avengers Disassembled, especially since Captain America 3 is Civil War. There's a big deal about the Avengers roster changing at the end of Age of Ultron.

    Just a random example, but I could see them using Spider-Man 2099 as a way to introduce the Time Gem.

    Most of the money was international, and studios tend to get a smaller cut of that. And there are concerns that ASM2 hurt the reputation of the franchise.

    Obviously it's still a top property for Sony, and Disney/ Marvel's interested in it, but there are reasons for the studios to worry.

    This. Introduce 2099 and just casually reference Peter Parker. Continuity is kept and regardless of where Sony or Marvel takes things we have a new spiderman without sacrificing the old. Furthermore 2099 adds further weight to unmasking because he could alter the timeline or cause big problems upon return to his own. 2099 can even lead to a new series of films once Marvel is done with the present day stuff.

    Peter in the comics was smooth enough to talk to girls. When maguire does it he's a marshmellow. Also there was no other scenes of garfield smooth talking to girls. He seems bad at that which is relatable. Also shy people stutter all the time too.
