    Doesn't matter. All that matters is that a character with the name existed before Marvel ever used said name. Moreover, Captain Marvel was a BESTSELLING character in the '40s. Marvel knew all too well that it was stealing a PROMINENT hero's name.

    As mentioned, Billy Batson is Captain Marvel.
    ALL of those Marvel Comics people are "name grabbers". ALL OF THEM.
