So if I have sex with a transexual without knowing it, is he/she raping me?

A comic character was just raped, so naturally its time for Rape Apologia: CBR edition.
But... Really? Isn't it sort of similar to that other case?
Ask yourself whether the police would charge someone in a particular case. You'll guess right most of the time. But you can always contact your state attorney general's office with any questions.
If it helps, Danny Bonaduce picked up a prostitute in Hollywood who turned out to be a man, and he beat the guy up. And Danny was the one who got arrested and convicted.

Or don't do it because, you know, it's a shitty thing to do.
Where was the same uproar when John Stewart was raped?
I think some people are missing the point here.
I talked about this in other places the first time Bunn implemented it in Lobo. I said it could be pretty interesting to see someone who always abused of his power towards others to suffer the same kind of fate and that could give him a new perspective in life and thus more character development.
What happened in the next issue?
Lobo was still kill-happy and started to murder all the different Corps while also flirting with Lyssa Drakk because obviously a rape victim would immediately want to have sex.
I'm afraid about how the ramifications about this won't be handled properly. Serious issues deserve to be treated with respect and only if you have the right skill for them.
After seeing the pages in question on Bleeding Cool...
My reaction is that it's a plot point for the shapeshifter to become pregnant with royal blood, entitling her future child to the throne.
It's very possible, that if this was a tv show, a movie or a novel, it would have been a very believable move by a person with the same motive and means.

I remember a scene in Revenge Of The Nerds that likely should be considered rape. When Lewis deceived his way into sex with the cheerleader while masked. She believed it was her boyfriend, Stan, until the mask was taken off. And it was treated for laughs in that movie. But it still was a rape.
Rape is a serious subject that seriously disturbs me. As a writer, I would never use it. Because I don't believe the subject is something that should be used in entertainment.
