The problem is that Sabretooth ignored a direct order from Magneto, although it was not yet a law.

That's the thing. Krakoa is a nation now. Sabertooth is punished for "breaking a law", not "breaking a direct order".

Sounds intentional to me. A scapegoat/patsy to ensure a demonstration of consequence, once consequence has been established.
